After a careful consideration of the record, we cannot say that the preponderance of the evidence appears to sustain the allegation
of gross negligence and, therefore, the record does not show an abuse of the trial judge's discretion. There was evidence,
however, though not a preponderance thereof, which tended to show that the defendant was guilty at the time and place of the
accident of gross negligence and that that gross negligence was proximate cause of the injury.
